2024 Rules and Regulations

Hours

8:00 AM – 12:00 PM Wednesday and Saturday

Products Sold:  All products sold at the Market must be grown or agriculturally related and made of farm products by the person or family selling the product.  Only home grown or home made products from the following counties may be sold:  Forsyth, Guilford, Alamance, Randolph, Davidson, Davie, Yadkin, Stokes, Surry, Rockingham, Caswell and Montgomery.  No buying and reselling of produce or other products is allowed.

Permitted Products:

A: Any vegetable grown by the seller from seeds, sets, or seedlings.
B: Any fruits, nuts or berries grown by the seller from trees, bushes, or vines on the    
     member’s property.
            C: Any plant grown by the seller from seed, seedling, transplant or cuttings.
            D: Bulbs propagated by the seller.
            E: Eggs produced by the seller’s poultry.
            F: Honey produced by the seller’s bees.
            G: Cut, dried flowers or natural items grown by the member.
H: Preserves, pickles, relishes, jams, jellies, made by the seller. No other canned foods
     such as green beans, tomatoes, corn, peas, carrots, etc. may be sold.
I: Baked Goods: Baked goods must follow all county and state laws applicable to such sales
    and shall verify that they will comply when submitting their application, including, but not   
    limited to, North Carolina Department of Agriculture (NCDA) and local health department
    regulations.
          J: Sustainable Livestock, limited to:

  1. Poultry
    1. Pasture raised on seller’s property.
    2. Slaughtered and processed in accordance with the consumer safety regulations of the USDA and NCDA.
    3. Hormone and antibiotic free.
    4. Sanitation, Transportation, Handling, and Storage of the meat for sale must be done in a manner compliant with all applicable county, state, and federal health and safety regulations.
    5. Sellers must be registered Meat and Poultry Handlers.
  2. Beef and Lamb
    1. Pasture Raised on seller’s property.
    2. Grass Fed throughout its lifecycle in accordance with the requirements of the USDA.
    3. Hormone and antibiotic free.
    4. Slaughtered and processed in accordance with the consumer safety regulations of the USDA and NCDA.
    5. Sanitation, Transportation, Handling, and Storage of the meat for sale must be done in a manner compliant with all applicable county, state, and federal health and safety regulations.
    6. Sellers must be registered Meat and Poultry Handlers.

K: Homemade and handmade craft items may be sold by approved vendors if you are
raising and selling your own produce or baked goods as long as you are not buying and reselling the product.  No weapons will be allowed to be sold.

Fees and Charges:  Annual Fees: $125 – Saturday and Wednesday sessions
$100 – Saturday only
          $50 – Wednesday only   

Daily Fee:  Space available – First come/First served
$5 – Wednesday morning 
$10 – Saturday

Assignment of Spaces:  Will be made by the Farmers Market Coordinator.  If multiple vendors are applying to sell the same items of the same quality, preference will be given first to vendors residing in the Kernersville corporate limits and then according to vendor proximity to the Kernersville area.

Set Up Time:  All vendors must be set up and ready for business fifteen (15) minutes prior to opening time for the Market or their space may be assigned to another vendor unless prior arrangements have been made with the Farmers Market Coordinator.

Signage:  All vendors must display a sign with their name and address (City).
           
Product Liability:  All food items must meet state and local health regulations.  All produce must be of top quality.  Vendors are highly encouraged to have liability insurance for the products they sell.  As stated in the application, The Town of Kernersville is not liable for anything sold by any vendor.

Weights and Measures:  All vendors must comply with the North Carolina Statutes governing the weight and measurement of produce and other items sold. All scales must be approved as “Legal For Trade”. Anyone using scales must have them certified by the NCDA. For certification of a scale, contact the NCDA Standards Division.

Animals:  No live animals may be sold or given away at the Market.

Cleanliness:  Each vendor is responsible for keeping their assigned space clean during use and when leaving the facility.  Excess produce must be removed from the Market and not dumped in market trash containers.

Vehicular Safety:  Vendors should not move their vehicles in or out of the Market area during the times when such movement would pose a danger to people in the shopping area.  This includes, but is not limited to Market hours.

The Kernersville Farmers Market is sponsored by the Town of Kernersville and operated by a committee appointed by the Board of Aldermen of the Town of Kernersville.  This Farmers Market Committee is responsible for the routine operation of the Market in accordance with these duly adopted rules and regulations and specifically has the authority to interpret these rules and regulations.  Any objections to an interpretation of these rules must be filed in writing with the Town Manager.  The decision of the Town Manager regarding any such objection is final.  The Town reserves the right to interpret the Market Rules and to modify them as needed for the Market’s operation.
